I chatted a law school student up about this, and he had this to say —
A: Although it can be argued that it’s the depiction, the visual representation, that should be looked at in such instances.
Mii: But then that’s still flimsy, isn’t it? So if I dress up as a 15 year old character and do naughty photoshoots, that’s an offense?
A: Nope. Because in reality, you’re not a minor. On the other hand, in the fictional world of hentai, the reality is created by the writers. So if you’d have a situation where prosecution would be impossible based on the flimsiest of excuses (i.e. In the script, she’s 200 years old). And when faced with such a problem, courts (at least in this jurisdiction) have been known to construe the law liberally so that its spirit might be upheld.
Okay, that’s it… I hereby declare today, December 3rd, Inappropriate Mental Image Day.
I think my brain officially stopped working after the follow-up question, but i’m pretty sure the last part means nuanced creative folks shouldn’t have much to worry about.
